Part III: The New Case
The Supreme Court is about to hear another case, Fisher v. the University of Texas (2015) [Note: this case was heard once back in 2012, and the Court sent it back to the 5th Circuit Court for a review. When UT Austin won again in circuit court, Fisher appealed again to the Supreme Court. they just heard the second round of oral arguments in December].
1. First, look up the basic facts of the first case (2012). Who is Fisher, and why is she upset?
Write a paragraph (4-6 sentences) that describes the basic arguments of each side, and what the Court said back in 2015 [hint: they disagreed with the Circuit Court ruling].
2. Now for the longer bit: Go to this link and click on the "Oral Argument" link on the left. That will open a window where you can read the transcript and actually listen to the lawyers and Justices discuss the case. Read/listen to the arguments.
3. Lastly, write a 1-2 page response to the following questions:
a. What arguments or questions stood out to you? Name at least three things that you read/heard that were compelling to you.
b. Who do you think should win the case? Why?
